1. | Parties and Dictionary |
1.1. | This Agreement is made between the Hirer and RRC. |
1.2. | In this Agreement: |
(a) RRC means Richmond Rowing Club Incorporated; | |
(b) Hirer means the person or company identified as Hirer on the Quote and includes the Hirer's employees, servants, agents, invitees, licensees, sub-contractors, members, guests and so forth; | |
(c) Premises means the Richmond Rowing Club boat shed building comprising two floors and includes all fixtures, fittings, property and equipment of RRC and its members and any part of them; | |
(d) Venue means the area of the upper floor of the Premises hired by the Hirer for the function. | |
2. | Venue Hire fees |
2.1. | Venue Hire fees are as listed on the Quote provided. |
3. | Payment, deposit and cancellation |
3.1. | A deposit of 25% of the Hire Fee is payable at the time of booking as set out on the Quote provided. The deposit is non-refundable if the Hirer cancels the function less than two months prior to the function date set out on the Quote provided. |
3.2. | The balance of the Hire Fee is payable two months prior to the function date as set out on the Quote provided. The total amount of the Hire Fee will be forfeited if the Hirer cancels the function less than two months prior to the function date set out on the Quote provided. |
3.3. | The Hirer may be required to pay RRC a security deposit of $1000 two months prior to the function date if requested. Any damage to the Premises, additional cleaning or rubbish removal costs in connection with the Hirer's use of the Premises will be the responsibility of the Hirer to cover, and may be deducted from the security deposit at the discretion of RRC. |
3.4. | The security deposit if paid, less any costs deducted as set out in item 3.3, will be returned to the Hirer within 14 days of the function date. |
4. | Catering |
4.1. | The Hirer must use one of the RRC recommended caterers as identified on the RRC booking website. |
5. | Access prior to and post event |
5.1. | The Hirer may have access to the venue two hours prior to the function start time as set out on the Quote provided. |
5.2. | Access to the venue will be provided by the caterer that the Hirer has booked. The caterer is responsible for opening the venue and locking up at the end of an event. |
5.3. | The Hirer must have fully vacated the venue within 30 minutes of the function end time as set out on the Quote provided. |
6. | Liquor licence |
6.1. | Any liquor licensing requirements are to be organised through the RRC recommended caterer by the Hirer. |
6.2. | The Hirer may not organise a liquor licence with any other third party. |
6.3. | The Hirer may not license the event themselves. |
6.4. | The Hirer must have security personnel and caterer staff present until the Premises is vacated at the end of an event requiring a liquor licence. It is the responsibility of the Hirer to pay the costs associated with this. |
7. | Cleaning |
7.1. | The Hirer is responsible for removing from the Premises all items brought onto the Premises including rubbish and empty bottles immediately following the finish time of the function. |
7.2. | Standard cleaning comprising vacuum hall, wash kitchen and bar surfaces and floors, wash bathrooms, sweep stairs before and after the venue hire is included in the Hire Fee. |
7.3. | The cost of any additional cleaning and/or rubbish removal required will be passed onot the Hirer to pay, and may be deducted from the security deposit with RRC. |
8. | Security requirements |
8.1. | The Hirer is required to employ 2 security personnel for evening functions, one to be located at the front door and the other at the rear door. |
8.2. | Security personnel are to be booked through the RRC recommended caterer or selected from the list of security companies as set out on the Quote provided. |
8.3. | The Hirer is to inform RRC of the security arrangements. |
9. | Behaviour |
9.1. | The Hirer must behave responsibly at all times and not cause any nuisance, offence or inconvenience to others. |
9.2. | RRC reserves the right to remove or exclude from the Premises any person whose behaviour causes any nuisance, offence or inconvenience to others. |
9.3. | The Hirer must not: |
(a) use nails, tacks, drawing pins, duct tape, sticky tape or any other thing for decoration that may mark or damage the Premises; | |
(b) smoke anywhere inside the venue or on the Premises; | |
(c) use the venue or allow its use for any purpose other than that set out on the Quote provided; | |
(d) sub-hire the venue; | |
(e) bring any hazardous or flammable substances onto the Premises; | |
(f) exceed the maximum capacity for the Premises; | |
(g) Access areas of the Premises other than those described as the Venue. | |
10. | No Smoking |
10.1. | The entire Premises is a no smoking area. |
10.2. | It is the responsibility of the Hirer to inform all guests that the Premises is no smoking and that this includes the terrace. |
10.3. | Guests smoking will be asked to leave the Premises to smoke. |
10.4. | RRC reserves the right to remove or exclude from the Premises any person who refuses to move outside the Premises to smoke. |
10.5. | RRC reserves the right to charge an additional cleaning fee of $200 if there is smoking at an event. This fee will be passed onto the Hirer or deducted from the security deposit at RRC’s discretion. |
11. | Hirer indemnifies RRC |
11.1. | The Hirer indemnifies RRC and agrees always to keep RRC indemnified against all loss and damage, consequential loss and damage and any other claims or demands which RRC may incur or become liable to pay in respect of: |
(a) any act, default or omission by the Hirer; | |
(b) any act, default or omission by or on behalf of RRC when acting on behalf of or under the direction of the Hirer; | |
(c) the Hirer not proceeding with the function; | |
(d) the Hirer failing to complete a contract made between the Hirer and any third party for services to be provided during the course of the function; | |
(e) any activity conducted during the course of the function that brings RRC into disrepute; | |
(f) any accident or damage to property at the Premises, any loss of property from the Premises, any accident, damage or injury to any person or to the property of any person suffered at the Premises and its surrounds, where such occurrence arose by reason of the use of the Premises by the Hirer; | |
(g) any interruption to or adverse effect upon the use now or in the future of the Premises by RRC. | |
12. | Use of the Premises at Hirer's Risk |
12.1. | The Hirer will use the Premises entirely at the Hirer's own risk and by this Agreement the Hirer releases RRC from any and all liability resulting from any accident, loss, damage or injury to persons or property at the Premises. |
13. | Limitation of RRC liability |
13.1. | RRC gives no warranty that the venue hired will at any stage be adequate for the purposes of the Hirer or the function and the Hirer agrees that the Hirer will satisfy itself on this issue. |
13.2. | RRC will not be liable to the Hirer for any loss and damage arising from any inadequacy of the venue or the Premises. |
13.3. | RRC will not be liable to the Hirer for any loss and damage resulting from: |
(a) interruption to water, electricity and other services; | |
(b) industrial action; | |
(c) any force majeure occurrence including acts of the God, war, civil commotion, flood, storm, threats of violence and so forth. | |
14. | Damage to Premises |
14.1. | If the Premises are damaged in any way by any act or omission of the Hirer, the Hirer will pay to RRC on demand the costs incurred by RRC in repairing or reinstating the damage part of the Premises to its previous condition. |
14.2. | The Hirer must report to RRC as soon as the Hirer becomes aware of any such damage, and payment must be made within 7 days of the issue of an invoice to the Hirer by RRC. |
